There have been some interesting decisions on procedural matters in investment arbitration recently (including Quiborax SA v Bolivia, Giovanna a Beccara and others v Argentina). This conference will look at some of these issues including disclosure of evidence, state privilege, working with witnesses and experts. It will also cover consolidation of claims and transparency (open hearings, webcasting, transcript availability). Some of the topics including costs and mechanisms to control costs and time of the arbitral process will be considered from the perspective of whether investment arbitration is or should be different from commercial arbitration. It is hoped that through this dialogue the speakers will be able to distill some best practices on certain procedural matters.
